Licence agreement

The heynixi licence agreement.

This agreement is between you and Md Abrar Ibn Habib ("we", "us"). By installing or using heynixi you agree to it. If you do not agree, do not install or use heynixi.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use heynixi on devices you own or control, free of charge. We keep all rights not expressly granted.

2. What you may not do

Except where the law or an open-source licence (section 3) allows it, you may not: sell, rent, sublicense or redistribute heynixi; remove its notices; reverse engineer, decompile or disassemble it; or use it to break the law or infringe anyone's rights.

3. Open-source components

heynixi includes third-party components under their own licences, listed in THIRD-PARTY-NOTICES.md beside the application (and on the licences page). Those licences govern those components, and nothing in this agreement limits rights they give you - including, for the LGPL-licensed Qt libraries, the right to replace them with a modified version and to reverse engineer heynixi to the extent needed to debug such modifications.

4. What heynixi does on your computer

heynixi acts on your PC when you ask it to: it opens apps and websites, types and pastes text, presses keys, clicks controls in the window in front, and reads the screen. Speech recognition and AI models make mistakes - heynixi can mishear you, misunderstand you, or act in the wrong window. You are responsible for reviewing what it does and for the results. Do not rely on heynixi where a mistake could cause injury, financial loss, or harm to others, including emergency, medical, legal, financial, or safety-critical uses.

5. AI output

Answers, summaries, written text and descriptions of your screen are generated by AI models and may be inaccurate, incomplete or offensive. They are not professional advice. Check anything important before you rely on it or share it.

6. Listening and other people

When "Hey Nixi" is on, heynixi listens to the microphone continuously (processed on your PC; see the privacy notice). Some places require the consent of everyone being listened to or recorded. You are responsible for using the wake phrase, dictation, screen reading and camera features lawfully and for turning listening off where others have not agreed to it.

7. Third-party services

Websites and services you ask heynixi to open or contact are provided by others under their own terms. We do not operate them or control their availability. Two features use public services on their own: downloading Nixi's brain (an AI model, from Hugging Face, only when you choose to) and synced lyrics (song details sent to LRCLIB, lrclib.net). The model is Qwen3.5 by the Qwen team, under the Apache License 2.0; lyrics are provided by LRCLIB's contributors.

8. Privacy

How heynixi handles your data is described in the privacy notice (docs/PRIVACY.md beside the application and at heynixi.app/privacy).

9. Beta software and updates

heynixi is beta software. Features may change, break or be removed, and we may stop providing it at any time.

10. No warranty

TO THE FULLEST EXTENT PERMITTED BY LAW, HEYNIXI IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING FROM OR RELATED TO HEYNIXI OR THIS AGREEMENT, HOWEVER CAUSED, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR HEYNIXI IN THE 12 MONTHS BEFORE THE CLAIM AND USD 50.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you. Nothing in this agreement limits liability that cannot be limited by law, or your statutory rights as a consumer.

12. Your responsibility

To the extent permitted by law, you will compensate us for claims by others arising from your unlawful use of heynixi or your breach of this agreement.

13. Ending this agreement

You may end it at any time by uninstalling heynixi. It ends automatically if you breach it. Sections 3, 4, 5 and 10 to 15 survive.

14. Changes

We may update this agreement. The version shipped with, or presented when you install, a given release applies to that release.

15. General

This agreement is governed by the laws of Ontario, Canada, and disputes will be resolved in the courts of Ontario, Canada. If any part of this agreement is unenforceable, the rest remains in effect. Not enforcing a term is not a waiver of it. This agreement is the entire agreement between you and us about heynixi. You must comply with applicable export-control and sanctions laws.
